PROLONGED DETENTION: A Short Documentary on the Landmark 'Lora' Case
Lora is a famous name in New York immigration courts. Thanks to a case Alex Lora and his legal team at Brooklyn Defender Services (BDS) and New York University School of Law (NYU) brought to challenge his immigration detention, since 2015, all immigrants detained for six months in the Second Circuit now have the right to a day in court where a judge can determine if their continued detention is justified.
Next Wednesday, on November 30, 2016 the Supreme Court will hear Jennings v. Rodriguez, a case brought by the American Civil Liberties Union (ACLU) that could provide nationwide access to bond hearings to immigrants like Mr. Lora who are held in long-term detention.

What is a prolonged detention by police? So we know that the police need reasonable suspicion to temporarily detain somebody. Sometimes this is known as a terry stop. The point of a terry stop is to either rule in or rule out the initial, objectively reasonable, and individualized suspicion that criminal activity may have occurred, is occurring, or is about to occur.
Sometimes it's a stop and frisk. Let's say someone is walking around and they have the outline of a gun sort of on their pocket or visible from their pocket and they are pacing nervously in front of a bank. A cop can temporarily detain that guy and do a frisk.
Now let me tell you about a US Supreme case from 2015 in a traffic stop context. And this case is titled Rodriguez v. United States, and there, Rodriguez was pulled over for driving on a highway shoulder. Then after checking the license, insurance, and registration, issuing a warning, the cop asked if he could walk his dog around the car. And Rodriguez is like, "No, thanks. I'm good."
So the cop called in for backup, which took about seven or eight minutes, and then the dog was walked around. It had an alert. They searched the car and drugs were discovered and seized. And Rodriguez was obviously charged. And so here's what the US Supreme Court held. Yes, the initial stop was legal, but what was illegal and in violation of Mr. Rodriguez's Fourth Amendment rights was the seven or eight minute wait, the period of detention without any reasonable suspicion of anything other than the traffic violation, which was already taken care of, was unreasonably prolonged. And therefore the drugs found, following the legal prolonged detention, has to get thrown out.
Now, let's say that during the stop for the traffic violation, the cop would have smelled an odor or had seen something in the car in plain view. Well, then there would have been reasonable suspicion to detain beyond the initial reason for the stop, which was driving on the shoulder. And therefore that detention would have been okay, that continued detention would've been okay.
